The COlinka Platform (hereinafter the “Platform”) is published on a personal basis by: - Name: Martin Victor - Email: contact@colinka.com (hereinafter the “Publisher”). The Platform is currently offered as part of a project / testing phase, with free access (FREE offer) and usage limitations.

The Platform provides a tool-based environment for teachers to organize and deliver online lessons, including in particular: video conferencing, calendar, homework, exercises, memos, playlists/resources, internal messaging, and file sharing. The Platform provides technical means and is not a party to the pedagogical/contractual relationship between teachers and students.

Creating an account is required to access certain features. The user undertakes to provide accurate information and to keep their credentials confidential. Any activity carried out through an account is deemed to have been performed by its holder, unless proven otherwise.

The FREE offer includes limitations that may include: - a monthly quota of video conferencing hours; - a maximum number of students per account; - feature restrictions. These limitations may change for technical, security or resource management reasons, without compensation.

It is prohibited to use the Platform to: - publish/share unlawful, hateful, violent, discriminatory or defamatory content; - harass, threaten, insult; - impersonate another person; - infringe the rights of third parties (privacy, image rights, intellectual property); - distribute malware/malicious links; - commit fraud, phishing, spam; - attempt unauthorized access. The user is solely responsible for the content, messages, files and data they publish, share or store via the Platform.

Any person aware of fraudulent, unlawful, abusive or suspicious use (or having a legitimate doubt) is invited to report it: - via internal messaging (if available) - or to: contact@colinka.com The Publisher may restrict, suspend or delete an account/content in the event of a breach of the ToU or a security risk.

The Platform is provided “as is” as part of a project. It may be interrupted (maintenance, incident, update, overload). No continuous availability is guaranteed.

The Publisher is not responsible for: - exchanges between users, - the quality of lessons, - shared content/files, - unlawful acts committed by users, - failures of third-party services (hosting, etc.). The Publisher shall not be liable for indirect damages (loss of unsaved data, loss of business, etc.).

The Platform and its elements (code, interfaces, texts, logos) are protected. Any unauthorized reproduction/use is prohibited. User content remains their property; the user grants a technical license necessary for hosting/displaying/transmitting the content via the Platform.

The ToU may be modified at any time. The applicable version is the one published at the time of use.
